Terms of Use
Effective: October 7, 2026
These Terms of Use govern your access to and use of crossmerge.com (the “Site”), which is operated by CrossMerge LLC (“CrossMerge,” “we,” “us,” or “our”). By using the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.
1. Website Purpose
The Site provides general information about CrossMerge and its Technology, Maintenance, Entertainment, and other business capabilities. Website content is provided for informational and business-development purposes and may be changed without notice.
2. No Service Agreement Created
Visiting the Site, contacting CrossMerge, requesting information, or discussing a potential project does not by itself create a customer relationship, service agreement, professional engagement, warranty, or obligation for CrossMerge to perform services.
Any actual services will be governed by the applicable written quote, proposal, statement of work, event agreement, service agreement, purchase order, or other agreement accepted by CrossMerge and the customer. If such an agreement conflicts with these website Terms regarding the services covered by that agreement, the applicable service agreement will control.
3. Quotes, Availability, and Website Information
Descriptions of capabilities, services, schedules, availability, pricing concepts, or other information on the Site are not binding offers unless CrossMerge expressly states otherwise in a written agreement. Service availability and requirements may vary by project, location, scope, schedule, personnel, equipment, and other circumstances.
4. Permitted Use
You may use the Site for lawful informational and business purposes. You may not attempt to disrupt the Site, gain unauthorized access to systems or data, introduce malicious code, misuse automated systems, impersonate another person or organization, infringe intellectual property rights, or use the Site in violation of applicable law.
5. Intellectual Property
Unless otherwise indicated, the Site and its original text, graphics, branding, logos, design, layout, and other content are owned by or licensed to CrossMerge and are protected by applicable intellectual property laws. You may view and use Site content for ordinary personal or business evaluation purposes, but you may not reproduce, distribute, modify, publish, sell, or commercially exploit CrossMerge content without permission except as allowed by law.
6. Third-Party Content and Links
The Site may contain links to third-party websites, platforms, products, or services. Such links are provided for convenience and do not necessarily constitute endorsement. CrossMerge does not control and is not responsible for third-party content, availability, security, terms, or privacy practices.
7. Disclaimer
To the extent permitted by law, the Site and its content are provided on an “as is” and “as available” basis. CrossMerge does not warrant that the Site will always be uninterrupted, error-free, secure, current, or suitable for a particular purpose. Nothing on the Site should be interpreted as a guarantee of a particular project, technical, maintenance, event, financial, legal, or other outcome.
8. Limitation of Liability
To the extent permitted by applicable law, CrossMerge LLC and its owners, employees, representatives, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of, inability to use, or reliance on this Site. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
9. Privacy
Your use of the Site is also subject to our Privacy Policy, which describes our privacy practices.
10. Governing Law
These website Terms of Use are governed by the laws of the State of West Virginia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
